Die saak verskaf duidelikheid ten opsigte van die betekenis van die woord erfgenaam soos gebruik in die Boedelwet. Dit verduidelik die eksekuteur se reg om boedelbates te vervreem asook wanneer die meester moet toestem tot die wyse en voorwaardes van verkoop. Laastens hanteer dit die gebrek aan locus standi van die begunstigdes van ‘n testamentêre trust ten opsigte van boedel aangeleenthede.

(This case provides clarity on the meaning of the word “heir” as used in the Administration of Estates Act. It also explains the executor’s right to dispose of estate property and when the master has to agree to the manner and conditions of sale. Lastly it deals with the lack of legal standing of beneficiaries of a testamentary trust to institute legal action in regard to the estate.)
