Court case on authorisation of one trustee to act for trustees

In Davids NO and Another v Tai Ross Properties VDBP (Pty) Ltd [2016] ZAGPPHC 97, the two trustees of a trust did not properly authorise one of them to act on behalf of the trustees when entering into an agreement with a third party.  The court held that the actions of a trustee who acted without authority of the other trustees cannot be rectified ex post facto.
