Draft bill on amendments to various acts with a fiduciary impact

The Department of Justice and Constitutional Development published a draft bill, the Judicial Matters Amendment Bill [B7-2023] with, inter alia, proposed amendments to the Intestate Succession Act, the Maintenance of Surviving Spouses Act, and the Matrimonial Property Act.

The amendments are aimed at following the instructions of the Constitutional Court in the Bwanya case, and in the Sithole case.

The bill also proposes various technical amendments to the Administration of Estates Act, inter alia making provision for electronic payments in section 28, and for authority for the Chief Master in section 95 to overrule a decision by a Master on an objection against a liquidation and distribution account.
