Premiums and Problems Article Edition 130: Managing firearms in a deceased estate: a guide for financial planners

Madeleine Britz wrote an article on managing firearms in a deceased estate for Premiums and Problems Article Edition 130 (January 2025), published by Old Mutual Personal Finance Legal Division.  The article is a must-read for executors.

Madeleine explains how firearms must be managed in a deceased estate under South Africa’s Firearms Control Act 60 of 2000. She outlines the legal responsibilities of executors, heirs and financial planners, including the safe storage, licensing, transfer or disposal of firearms after a firearm owner’s death. Executors must notify the Registrar of Firearms within 14 days, inventory all firearms and ensure they are stored in accordance with legal requirements. Heirs who wish to inherit firearms must obtain the necessary competency certificates and licences before taking possession. Failure to comply can result in substantial fines or imprisonment, making careful estate planning and professional advice essential.
