A recent High Court ruling has strengthened the rights of life partners in South Africa, allowing financially dependent partners to claim interim maintenance after separation. The ruling confirmed that courts may recognise “marriage-like” relationships, even without formal marriage, if dependency and commitment are proven. However, establishing such a partnership remains complex and requires strong evidence.
As FISA CEO Jan du Plessis explains, the court relied on clear proof of support obligations and dependency, noting the case was unusually strong. He adds that proving a life partnership, especially where one partner is still legally married, can be difficult and may lead to further legal disputes.
