The Minister of Rural Development and Land Reform published an amendment to Regulation 68, as well as to some forms, in the Regulations under section 10 of the Deeds Registries Act, 47 of 1937. The upshot of the change is that the process to have lost or destroyed title deeds replaced with copies is changed. Any application to the relevant deed office for such copies will have to be accompanied by an affidavit sworn to in front of a notary public. This will no doubt increase the cost of this process of obtaining copies.
The amended regulation was published under R.62 in Government Gazette 42186 of 25 January 2019, and will come into effect within one month of publication, i.e. on 25 February 2019. Click here for a copy.
